"Service Provider": Thyme 2 Play LLC provides the platform technology
"Participating Venues": Independent businesses using our white-label platform
"Users": Individuals participating in venue-sponsored reward programs
1. Acceptance of Terms
Welcome to the Thyme 2 Play engagement platform (the "Platform"), operated by Thyme 2 Play, LLC ("Thyme 2 Play," "we," "our," or "us"). By accessing or using our Platform through any participating venue's branded interface, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.
These Terms constitute a legally binding agreement between you and Thyme 2 Play, LLC. We may update these Terms from time to time, and your continued use of the Platform after any changes constitutes acceptance of the new Terms.
2. Platform Description and Service Model
2.1 Our Platform
Thyme 2 Play provides a white-label gamified engagement platform designed for hospitality venues. Our Platform allows users to participate in interactive sports-themed contests and challenges to earn promotional credits and rewards that can be redeemed at participating restaurants and hospitality venues.
2.2 White-Label Service Model
Technology Provider: Thyme 2 Play, LLC develops, hosts, and maintains the Platform technology
Participating Venues: Independent hospitality businesses that license our Platform under their own branding
Your Relationship: While you interact with a participating venue's branded interface (such as "[Venue Name] Rewards"), the underlying Platform technology and these Terms of Service are provided by Thyme 2 Play, LLC
2.3 Platform Features
Interactive sports-themed challenges and contests
Skill-based gameplay requiring knowledge and strategy
Reward system providing promotional credits for venue redemption
Free-to-play platform with no entry fees ever
Integration with participating hospitality venues
Platform Purpose: Our Platform is offered for entertainment and customer engagement purposes and operates as a technology solution for venue loyalty rewards programs.
3. Venue Relationships and Responsibilities
3.1 Independent Venue Operations
Each participating venue is an independent business that licenses our Platform technology
Venues maintain their own policies regarding reward redemption, customer service, and venue operations
We do not own, operate, or control participating venues
Venues may add supplementary terms and conditions specific to their establishment (see Section 3.3)
3.2 Our Role vs. Venue Role
Thyme 2 Play Responsibilities:
Platform development, hosting, and technical maintenance
User account management and Platform security
Contest management and promotional credit issuance
Compliance with these Terms of Service and applicable privacy laws
Participating Venue Responsibilities:
Reward redemption and customer service at their location
Venue-specific policies and additional terms
Local compliance with applicable laws and regulations
Customer disputes related to reward redemption or venue services
3.3 Venue-Specific Terms
Participating venues may supplement these Terms with additional terms specific to their establishment ("Venue Addendum"). Any Venue Addendum will be clearly displayed and must be accepted in addition to these Terms. In case of conflict between these Terms and a Venue Addendum, these Terms will control except for venue-specific matters such as:
Reward redemption policies and procedures
Venue-specific contest rules or promotions
Local customer service policies
Venue operating hours and policies
4. Eligibility and Account Registration
4.1 Age and Legal Capacity
You must be at least 18 years old to use our Platform. By using the Platform, you represent and warrant that:
You are 18 years of age or older
You have the legal capacity to enter into this agreement
Your use of the Platform complies with all applicable local, state, and federal laws
4.2 Account Requirements
You must provide accurate, current, and complete information during registration
You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account
You may not create multiple accounts or share your account with others
We reserve the right to suspend or terminate accounts that violate these Terms
4.3 Geographic Restrictions
Our Platform is intended for users located in jurisdictions where loyalty reward programs and promotional activities are legal. You are responsible for ensuring your participation complies with your local laws.
5. Rewards Program and Promotional Credits
5.1 Earning Rewards
Promotional credits are earned through participation in skill-based contests and challenges on our Platform
Rewards are issued by Thyme 2 Play based on performance and participation in Platform activities
All promotional credits earned are for use exclusively at the participating venue where you earned them
Promotional credits have no cash value and cannot be transferred, sold, or exchanged for cash
5.2 Redeeming Rewards
Promotional credits may only be redeemed at the specific participating venue where they were earned
Each venue maintains its own policies for credit redemption, which may be outlined in their Venue Addendum
Credits may have expiration dates as determined by individual venues
We are not responsible for venue-specific redemption policies, limitations, or disputes
Venues reserve the right to modify their redemption policies with appropriate notice
5.3 No Purchase Necessary
Participation in our Platform is always free
No purchase, payment, or entry fee is ever required to participate in contests or earn rewards
Thyme 2 Play will never charge users for participation in any aspect of our Platform
5.4 Platform Credit Management
We maintain the technical systems for tracking and managing promotional credits
Credit balances are maintained on our Platform and synchronized with venue systems
We reserve the right to adjust credit balances for technical errors, fraud prevention, or Terms violations
6. Platform Rules and User Conduct
6.1 Fair Play and Contest Rules
All participants must play fairly and in accordance with the spirit of competition
Use of automated tools, bots, or any artificial means to gain an unfair advantage is strictly prohibited
Manipulation of contest results or reward systems is forbidden
You may not attempt to exploit or circumvent the scoring or reward systems
Contest rules may vary by venue and will be clearly displayed for each specific challenge
6.2 User Conduct and Content
You agree not to use the Platform to:
Violate any laws or regulations
Harass, threaten, or harm other users
Upload or transmit malicious software or code
Attempt to gain unauthorized access to our systems or other users' accounts
Interfere with the proper functioning of the Platform
Use the Platform for any unauthorized commercial purposes
Post or transmit any content that is:
Offensive, abusive, defamatory, or inappropriate
False, misleading, or deceptive
Infringing on intellectual property rights
Spam or unsolicited commercial communication
Containing personal information of others without consent
6.3 User-Generated Content
When user-generated content features are available:
You are solely responsible for all content you post or submit
You must not post content that violates these Terms or applicable laws
We reserve the right to remove any content at our discretion without notice
You grant Thyme 2 Play a worldwide, non-exclusive, royalty-free license to use, display, reproduce, modify, and distribute your content in connection with the Platform and our business operations
6.4 Consequences of Violations
Violations of these Terms may result in:
Warning notices
Temporary or permanent account suspension
Forfeiture of any earned promotional credits
Removal of user-generated content
Legal action if appropriate
Notification to participating venues of violations
7. Intellectual Property Rights
7.1 Thyme 2 Play Platform Property
The Platform, including all content, features, functionality, logos, designs, text, graphics, software, and "Thyme 2 Play" branding, is owned by Thyme 2 Play, LLC and is protected by copyright, trademark, and other intellectual property laws. You may not:
Copy, modify, distribute, or create derivative works of our Platform content without permission
Remove or alter any proprietary notices
Use our trademarks or logos without written permission
Reverse engineer or attempt to extract source code
Use our Platform technology for commercial purposes without authorization
7.2 Venue Branding
Participating venues license the right to use their own branding on our Platform interface. Venue-specific branding, logos, and trademarks remain the property of the respective venues.
7.3 User Content
You retain ownership of any content you submit to the Platform ("User Content"), but you grant us the rights described in Section 6.3.
You represent and warrant that:
You own or have the right to use all User Content you submit
Your User Content does not violate any third-party rights
Your User Content complies with these Terms and applicable laws
7.4 DMCA Compliance
We comply with the Digital Millennium Copyright Act (DMCA) and will remove material that infringes copyright upon proper notification. To report copyright infringement, please contact us at [DMCA EMAIL] with:
Your contact information and electronic signature
Description of the copyrighted work claimed to be infringed
Location of the allegedly infringing material on our Platform
A statement of good faith belief that use is unauthorized

8. Privacy and Data Protection
Your privacy is important to us. 9. White-Label Platform Operations
9.1 Technology Service Model
Our Platform operates as a white-label technology solution provided to hospitality venues to enhance customer engagement and loyalty. Users access our technology through venue-branded interfaces while these Terms govern the underlying Platform usage.
9.2 No Gambling or Gaming License Required
Our Platform does not constitute gambling, betting, or wagering
All contests are skill-based with promotional rewards, not monetary prizes
No gaming license is required for our business model
Participation is free and rewards are promotional in nature
9.3 Promotional Activities Classification
All rewards and promotional credits distributed through our Platform are considered promotional activities designed to increase customer engagement and loyalty for participating venues.
9.4 Platform Availability
We strive to maintain Platform availability but do not guarantee uninterrupted service
We may perform maintenance, updates, or modifications that temporarily affect Platform access
We reserve the right to modify Platform features with reasonable notice
10. Third-Party Services and Integrations
10.1 Venue Integration
Our Platform integrates with participating venue systems to provide a seamless experience. We are not responsible for:
Venue system outages or technical issues
Data synchronization delays between our Platform and venue systems
Venue-specific technical requirements or limitations
10.2 Third-Party Service Providers
We may use third-party services for Platform operations (hosting, analytics, etc.). These providers are bound by appropriate data protection and confidentiality agreements.
11. Disclaimers and Limitation of Liability
11.1 Platform Availability
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THYME 2 PLAY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
The Platform will be uninterrupted, timely, secure, or error-free
Results obtained from use of the Platform will be accurate or reliable
Any defects in the Platform will be corrected
The Platform is free from viruses or other harmful components
Participating venues will honor promotional credits
11.2 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THYME 2 PLAY SHALL NOT BE LIABLE FOR ANY:
INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE PLATFORM
DAMAGES RESULTING FROM VENUE POLICIES OR CREDIT REDEMPTION ISSUES
DAMAGES RESULTING FROM ANY UNAUTHORIZED ACCESS TO YOUR ACCOUNT
LOSS OR FORFEITURE OF PROMOTIONAL CREDITS
ACTIONS OR INACTIONS OF PARTICIPATING VENUES
Our total liability to you for any claim arising out of these Terms or your use of the Platform shall not exceed $100.
11.3 Venue-Related Disclaimers
Thyme 2 Play is not responsible for:
The actions, policies, or services of participating venues
Disputes between you and participating venues
Changes in venue participation or redemption policies
Quality of goods or services provided by venues
Venue compliance with local laws and regulations
12. Indemnification
You agree to indemnify, defend, and hold Thyme 2 Play, LLC harmless from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
Your use of the Platform
Your violation of these Terms
Your violation of any rights of a third party
Any User Content you submit
Your interactions with participating venues (except where venue is solely at fault)
13. Termination
13.1 Termination by You
You may terminate your account at any time by contacting us at [SUPPORT EMAIL] or using account deletion features in the Platform.
13.2 Termination by Thyme 2 Play
We may, in our sole discretion, terminate or limit your access to the Platform at any time for any reason, including violation of these Terms, with or without notice.
13.3 Venue Participation Changes
Venues may discontinue their participation in our Platform at any time
If a venue discontinues participation, your promotional credits with that venue may be forfeited
We will make reasonable efforts to provide notice of venue participation changes
13.4 Effect of Termination
Upon termination:
Your right to use the Platform immediately ceases
We may delete your account and all associated data
Any unused promotional credits may be forfeited
Provisions of these Terms that should survive termination will remain in effect
14. Force Majeure
Thyme 2 Play shall not be liable for any failure to perform our obligations due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, government actions, internet failures, technical malfunctions, or changes in venue participation.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of [YOUR STATE], without regard to its conflict of laws principles.
15.2 Jurisdiction

16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy and any applicable Venue Addendum, constitute the entire agreement between you and Thyme 2 Play regarding the Platform.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
16.3 Waiver
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
16.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. Thyme 2 Play may assign these Terms at any time without notice to you.
16.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights except for participating venues' rights to set their own redemption policies through Venue Addenda.
16.6 Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email. Your continued use after changes constitutes acceptance.
16.7 Headings
Section headings are for convenience only and do not affect the interpretation of these Terms.
16.8 Venue Addenda
Participating venues may supplement these Terms with venue-specific addenda. Such addenda are considered part of your agreement when using that venue's branded interface.
